- Actuate Toolbox, hereafter called AT, is owned and operated by Valley
Web Services, hereafter called VWS.
- The fact that The Actuate Toolbox specializes in Actuate designs, and
maintains the Actuate.NET web site does not in any way infer an
agreement or connection between VWS and The Actuate Software
Corporation.
- All WW designs are accepted with
no promise of support or guarantee that all designs will be
applicable to your specific applications.
- Although the concepts and designs presented by WW may be reused in a
commercial application, the actual WW designs or libraries will not be sold or
redistributed, or used for any similar purpose without the express
consent of VWS.
- The WW database cannot be used for any other application except
for viewing and/or running WW designs.
- The additional files (HTML, JavaScript, etc) are provided as
extras, with no promise of delivery or any level of service.
- It is possible that a design submitted for publication has already
been submitted for distribution by WW. There is nothing to be gained
by not giving credit for a design submission. If the design is
a new idea, credit will be given, otherwise credit will go to the
first person suggesting the design. In case of a design
developed by VWS, but not yet published, credit will go the the
first person submitting that design.
- The membership subscription is not refundable.
- iServer deployment is a bonus to members, but is not a requirement.
Access to designs may be through a standard password-protected web page when
necessary.
- If for any reason, VWS cannot fulfill the terms of the membership
agreement, the prorated balance of the membership fee or renewal fee
will be refunded by VWS. At that point there is no further
obligation by either party.
- Any subscription can be terminated for unauthorized access into
any area of the iServer or web server, or
breach of protocol or security. The individual members have no recourse
for termination for a documented offense. In the case of a
corporate license, only the individual will be terminated, not the
company.
- Renewals will not be automatic. Reminders will be sent out
approximately sixty days prior to expiration of your membership. If renewal is not received
in time,
membership will be terminated. In such a case, there will be
$30 reinstatement fee. If a situation prevents renewal in
time, if you let us know prior to termination, the account may be
kept open at the sold discretion of VWS.
- WW and VWS accepts no legal or financial liability
for any design presented, or the termination of any membership.
- These Terms and Conditions are updated on a quarterly basis during the development and growth of
The Actuate Toolbox.
